Details of important consumer Terms & Conditions and Operator Responsibilities relevant to all tour arrangements and information contained in this web site are outlined above. It is essential that these conditions and responsibilities are carefully read and understood prior to making a booking. Additionally, details or particular tours described in this site may have altered since. Changes in airfares, operators' tariffs and currency exchange rates may affect the price of particular tours. For these reasons, it is imperative that the client reconfirms all arrangements at the time of booking and prior to making payment. Please read these Terms & Conditions carefully, by making a reservation with us, you have agreed to accept the Terms & Conditions herein.

    RESERVATIONS
       
    All reservations are subject to availability at the time of booking. Reservations will only be confirmed after FocusTourChina.com receives written confirmation of your booking from the hotel, airline or tour operator.

    Air
    No new bookings or revisions may be made inside of 7 days prior to arrival.

    Hotel & Tours
    Late Booking Reservations made within 14-8 days prior to tour arrival for tour booking or 7 days prior to hotel check-in date for hotel-booking-only will incur a non-refundable late booking fee of US$25.00 per file. Full payment for the package together with the late booking fee must be received by FocusTourChina.com within 48 hours of the booking request. No reservation will be processed until FocusTourChina.com receives the applicable payment. Failure to comply with these terms of payment will result in the automatic cancellation of the reservation request. In the event that the reservation cannot be confirmed, the late booking fee of US$25.00 will be retained by Focus Tour China.com. but the balance of money will be refunded.

    AMENDMENT
       
    Air
    Once tickets are issued, the fee of amendment is subject to the policy of different airlines. In addition to the charge levied by airlines, it is free of FocusTourChina.com¡¯s service charge for the first amendment, but there will be US$ 10 per ticket per change for any further amendment.
    A change to traveler name after air tickets have been issued will be treated as a cancellation and cancellation fees apply.

    Hotel Reservation
    Once hotel booking is confirmed, changes within 72 hours can be made for a US$ 10 per change as fee. Changes to a reservation outside of 72 hours are subject to the policy in different hotels. Items not included in the rates include but are not limited to: baggage handling, tips and gratuities, meals, roll away beds, and cribs. These items are the sole responsibility of the passenger and should be paid directly when the services are rendered.

    Tour
    A fee of US$50 per change may apply for any alteration or amendment made to a confirmed reservation. Airline penalties may also apply.

    PRICES
       
    Prices are based on tariffs and rates of current exchange and are quoted in US dollars. In the event of fluctuations in currency exchange rates, service providers' tariffs, fuel prices, accommodation rates and other tour service components, FocusTourChina.com reserves the right to adjust prices at any time up to and including the date of departure, even after receipt of the full payment from the client. Acceptance of this arrangement is an express condition of making a reservation. You will be notified of any alteration to advertised prices via e-mail, provided we have the correct email address.

    PAYMENT
       
    All transactions will be conducted in United States currency.

    Tour
    1. A non-refundable of $100 per person is required at the time of booking. The
    deposit will be deducted to your final payment.
    2. Final balance of the payment is due at least 20 days prior to tour arrival date.
    3. If a booking is made within 20 days before tour arrival date, full payment must
    be settled upon confirmation.

    Air & Hotel
    Once reservations are confirmed, payments must be made 10 days prior to arrival dates.

    Should the total payment not be received by due date, any reservations already made in respect of the tours, hotels and air tickets will be automatically cancelled.
    After you have made the wire transfer in your bank, please make a copy of the transaction receipt by the bank, write down your tracking code and tour code on the copy and fax us the copy of the transaction receipt (Fax no. 0086-10-58215305) or email us the scanned copy. Once we have received your payment fax or email, we will start to secure your booking.

    CANCELLATIONS & REFUND
       
    Air
    Once tickets are issued, a fee equal to 25% of the ticket price plus tax will be charged if the tickets are cancelled within 48 hours prior to original departure time. Airline penalties may also apply.

    Hotel Reservations
    There is no fee for cancellations or changes made outside of 72 hours (3 days) prior to arrival. Cancellations made within 72 hours (3 days) are subject to a fee equal to the first night plus tax.

    Tours
    Refunds or allowances will not be made for transportation, accommodations, tickets, services, or other portions of the tour which are unused on or after the tour arrival date. The following cancellation fees or refunds shall apply if, for any reason, the client cancels a tour. All cancellation terms are specified on a per person basis.

    The cancellation fees are calculated according to the days of notice received prior to scheduled date of entering China. The penalty will be a percentage on the tour price:
    15-10 days prior to the scheduled tour is 15%;
    9-5 days prior to the scheduled tour is 35%;
    4-2 days prior to the scheduled tour is 55%;
    24 hours prior to the scheduled tour or no show is 100%;
    After arrival date is 100%.

    For Yangtze River tour with the tourist boat, special provisions will be adopted:
    31 days prior to the scheduled tour is 25%;
    30-16 days prior to the scheduled tour is 55%;
    Less than 16 days prior to the scheduled tour is 100%;
    Such policy is imposed upon us by the tourist boat company.

    If an air inclusive tour is cancelled after air tickets have been issued, the cancellation fees will be subject to airline Tariff regulations; any applicable refunds will be processed after air tickets are returned to FocusTourChina.com. FocusTourChina.com reserves the right to cancel or reschedule any tours; the only responsibility of FocusTourChina.com will be to refund to the passenger the amount we have received for the tour reservation. All tour itineraries are subject to minor change upon local arrangement.

    INSURANCE
       
    There is no insurance coverage in our tour price. We strongly recommend that you take out comprehensive insurance cover against any cancellation, medical expenses, personal accident, personal baggage, money and public liability before you travel.

    OPERATION DETAILS
       
    Tour Operation
    Although FocusTourChina.com will endeavor to ensure that tours are available as advertised, an express condition of making a reservation is the acceptance by the client that tour itineraries and schedules, advertised accommodation, sightseeing programs and modes of transportation as outlined on this web site and/or supplied in pre-departure information are subject to change without prior notice. Air travel, coach journeys and other forms of transport and hotel accommodation are provided by independent operators and all bookings through FocusTourChina.com are subject to the terms, conditions and limitations of carriers, hotels and other service providers.
    If your booking needs to be altered due to circumstances beyond our control, we reserve the right to vary your itinerary and inform you of the subsequent changes. If the varied itinerary is only available at a higher cost, the client will bear the increased price. Should such changes result in an itinerary which is materially different from your requested program and we have accepted your payment, you reserve the right to withdraw from the tour program and all money received by FocusTourChina.com will be refunded in full.
    If for any reason, FocusTourChina.com is forced to cancel a tour program, clients will be offered an alternative tour of a similar standard and arrangement. Should the alternative be unsuitable to the client, all money paid to FocusTourChina.com in respect of the original tour program will be refunded in full.
    An alternative itinerary or a refund of money offered or paid in the event of a tour change or cancellation is in full satisfaction of any claim for loss of enjoyment resulting from the change or cancellation

    Single Travelers
    For group tours only, single travelers who are willing to share accommodation with another tour member must advise FocusTourChina.com at the time of reservation. FocusTourChina.com will endeavor to match the client with a suitable person for the duration of the selected tour. If FocusTourChina.com is unable to allocate a suitable person to share accommodation, the single supplement cost as specified is to be paid by the client at the time of balance payment. For clients who choose to have a sole occupancy of a room throughout the tour, the specified single supplement cost will be payable at the time of balance payment.
    For private tours, single occupancy of a room by choice or circumstance is subject to the applicable supplement cost and payable to FocusTourChina.com

    Items not Included in The Tour Price

    Passports; visas and vaccinations; unscheduled meals and international flight from and to your home city and airport taxes and fees; tips to your tour manager (national guide), tour driver, local city guides; gratuities on ferries and cruise ships; laundry, beverages; travel insurance; excess baggage fees; all other items of a personal nature.

    Travelers Who Need Special Assistance
    You must report any disability on the booking form at the time of reservation. We will assist the special needs of the less mobile travelers, but is not responsible in the event it is unable to do so. We regret that we cannot provide any individual assistance to a tour participant during the tour, so a qualified companion must accompany travelers who need such assistance, who must take total responsibility for the handicapped participant on the whole tour.

    Safety
    Please be aware that during your participation in tours operated by FocusTourChina.com, certain risks and dangers may arise beyond our control including, but not limited to, the hazards of traveling in undeveloped areas; travel by boat, train, automobile, aircraft or other means of transportation; the forces of nature, political unrest and accident or illness in remote regions without means of rapid evacuation or medical facilities. FocusTourChina.com will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. It is understood that FocusTourChina.com will use its best efforts to ensure that adequate measures are taken.

    PASSENGER RESPONSIBILITIES
       
    Travel Document
    A valid national passport is needed for all tours. Please make sure that your passport is valid for at least 6 months from date of travel. All passengers must obtain visas to visit China; it is your responsibility to make sure that you have obtained the visa before leaving your country.
    All clients must be in possession of a valid passport and necessary visas at the time of commencement of travel. All such documentation is the sole responsibility of the client. FocusTourChina.com accepts no responsibility or liability whatsoever for the failure of clients to obtain appropriate documentation. Check in at airline gate or ticket counter at least 1.5 hours for domestic flight and 2.5 hours for international flight prior to scheduled departure with valid photo ID for each passenger. Due to heightened security at all airports, airlines are checking photo identification on all passengers. The name of each ticket must match a valid photo ID shown at the airport.
    When a customer's ticket, or a portion of the ticket, is lost, stolen, or destroyed. He or she will be required to purchase a new ticket at the current fare. There will be no refund for a lost, stolen, or destroyed ticket. Passengers may not make changes in their route, city of origin or destination, or exchange or transfer their tickets to another passenger or another airline. Flight times are tentative and are subject to change without notice. It is suggested to confirm flight times 48 hours prior to departure.

    Health Requirements
    Clients should familiarize themselves with any health requirement applicable to areas they intend to visit. The client is solely responsible for compliance with vaccination and other health requirements of governments in countries visited or transited. The Department of Health or medical practitioners will be able to assist with current health requirements and recommendations.

    Luggage
    In accordance with the International Airline Regulations, the free luggage allowance for economy class passengers is 20kgs (44lbs) plus limited cabin luggage. Excess luggage charges are the sole responsibility of the client. Regulations within China specify that all suitcases must have a locking device attached. Failure to follow this regulation may result in refusal by airport staff to load suitcases onto the aircraft.

    Complaints and Claims
    Should the client feel that a valid complaint or claim should be lodged with FocusTourChina.com or its service providers, the client hereby agrees to the following procedures and terms: Should the client feel that a failure in performance of FocusTourChina.com or its suppliers has occurred, the client agrees to immediately inform the local service provider. At this time, the local service provider will endeavor to promptly resolve the matter of complaint and inform FocusTourChina.com of the specific circumstances. Should the local service provider be unable to assist or be unavailable, the client agrees to contact FocusTourChina.com by email or telephone. In the event of a claim of compensation, the client agrees to inform FocusTourChina.com in writing within 30 days of the date of tour completion. Relevant receipts and substantiating evidence, must be attached to the letter of claim. This will enable FocusTourChina.com to make a timely investigation. FocusTourChina.com will not be liable for any claims made later than 30 days after the date of tour completion.

    FocusTourChina.com's LIMITATION OF RESPONSIBILITY
       
    FocusTourChina.com is responsible to you in making arrangements for the tour services offered, including transportation, sightseeing, and accommodations. The carriers, accommodation providers, and other suppliers providing tour services are independent contractors and are not agents, employees, or servants of, or joint ventures with, FocusTourChina.com or its affiliates. All certificates and other travel documents for tour services issued by FocusTourChina.com subject to the terms and conditions specified by the suppliers, and to the laws of the countries in which the services are supplied.
    If, after tour departure, the services included in the tour cannot be supplied, or there are changes in an itinerary for reasons beyond the control FocusTourChina.com will arrange for the provision of comparable services. Any resulting additional expense will be payable by travelers and any resulting saving will be refunded by FocusTourChina.com to tour participants.
    The tour participant agrees that FocusTourChina.com shall not be liable for any damage, loss (including personal injury, death, and property loss) or expense occasioned by any act or omission of any supplier providing tour services, or any insurer or insurance administrator or of any other person. FocusTourChina.com shall not be liable for personal injury or property loss or damage resulting from the acts, omissions, or negligence of any person providing accommodations, transportation, or any other travel related services, but we will try our best to help our clients solve any problems they may have in China.
    FocusTourChina.com is not responsible for the exchange or refund for any lost, stolen, or destroyed documents. Unforeseeable circumstances such as force majeure, adverse weather conditions, airline flight rescheduling, hotel overbooking, and technical faults with transportation and road conditions may also have a consequential effect on the content and schedule of the tour after commencement. However, we will take all benefits and all losses of any fluctuations, lower or higher in airfares, cruise fares, currency devaluation, park fee increases, taxes, or fuel surcharges after we have received the full payment.
    All disputes occurring between clients and FocusTourChina.com should be settled through friendly negotiation. If the negotiations fail to function, they shall be submitted to the China Arbitration Committee for Economy and Trade. Arbitration work shall be done in either Chinese or English.
